Terms and Conditions
By purchasing a ticket and/or attending a Paint Your Peach workshop or event, you agree to the following:
Eligibility:
-You confirm that you are 18 years of age or older.
Custom Portraits:
-You trust the artist to create a hand-drawn, one-dimensional portrait that captures your likeness as accurately as possible. However, exact millimetre precision is not guaranteed.
-You are responsible for following the instructions in the email to submit your photo. Failure to follow these instructions may result in receiving a generic portrait.
Workshop Content:
-Workshops may include adult themes, such as nudity and/or the service or consumption of alcohol.
-Attendance and participation are entirely voluntary.
Privacy and Responsibility:
-Paint Your Peach handles your sensitive photos with care but acknowledges that sharing photos electronically involves minimal risk.
You are responsible for:
-Checking your email for instructions on photo submission.
-Ensuring your photo is sent correctly and in the requested format.
-Confirming receipt of your photo. If you do not receive confirmation within 48 hours, contact Sab via email at sab@artbysab.com.au or Instagram @paintyourpeach
If no photo is received on time, a generic portrait will be provided.
Damaged or Missing Canvases:
-If a canvas is lost or damaged during transport due to Sab’s error, a replacement will be provided with all materials included in the mail.
Cancellations and Refunds:
-All ticket sales are final and non-refundable, except in the event of cancellation by the host due to a Force Majeure event.
-No rescheduling, exchanges, credits, or partial refunds are available.
Force Majeure
In the event of Force Majeure (including but not limited to natural disasters, extreme weather, road closures, illness, venue closures, government restrictions, or other circumstances beyond Paint Your Peach’s control), the event may be postponed, rescheduled, relocated, or held in an alternative format.
No compensation will be provided for any inclusions or entitlements impacted by such circumstances.
If your portrait has already been drawn at the time of cancellation or postponement, a partial refund may be available. In this case, your canvas will still be provided and mailed to you along with paint and brushes, with shipping covered at Paint Your Peach’s expense.
Alcohol Service (if applicable):
-Responsible Service of Alcohol rules apply. The host reserves the right to refuse service or ask attendees to leave if necessary.
Liability Waiver:
-You unconditionally release and hold harmless Paint Your Peach, its employees, and agents from any claims arising from personal injury or damages connected to the event, whether caused by negligence, error, or otherwise.
Indemnity:
-You agree to indemnify Paint Your Peach and partners from any claims resulting from personal injury connected to the event or activities.
Paint Your Peach – Kit Order and Commissions Terms & Conditions
By placing an order with Paint Your Peach, you acknowledge and agree to the following terms:
1. Photo Submission & Participant Consent
If your kit requires a reference photo, you confirm that:
you are the person in the photo, or
you have received full consent from the person featured in the photo for it to be used to create a Paint Your Peach portrait.
Paint Your Peach is not responsible for photos submitted without the subject’s consent. Any consequences resulting from non-consensual photo submissions are the responsibility of the person placing the order.
2. Privacy & Respect
All photos submitted are treated with discretion and respect. Photos are used only for the purpose of creating your portrait and will never be shared publicly without your explicit permission.
3. Artistic Interpretation (Not a Printing Service)
Paint Your Peach is not a printing or photo-replication service. Each portrait is hand-drawn in Sabrina’s signature style and is an artistic interpretation of the reference image.
By ordering, you acknowledge that you are trusting the artist’s creative process and that the final silhouette may not be an exact replica of the original photo.
4. Portrait Style
Paint Your Peach portraits are designed as simplified silhouettes and do not include detailed items. Any request for detailed tattoos or lingerie may incur extra fees.
5. Custom-Made Products
All kits are made to order and involve custom hand-drawn work. Once your portrait has been created and your kit has entered preparation, changes may not be possible.
6. No Refund Policy
All Paint Your Peach kit orders are non-refundable, including for change of mind. You may be eligible for credit.
7. Store Credit Only
If an issue arises, Paint Your Peach may offer store credit at its discretion. Store credit may be used toward a future kit or event and is not redeemable for cash.
8. Dispatch & Shipping Timeframes
Paint Your Peach is a small business, and shipping timeframes may vary depending on order volume, production workload, and touring schedule.
By placing an order, you acknowledge that dispatch and delivery may take longer than standard retail timeframes.
9. Lost or Delayed Parcels
Once your parcel has been shipped, Paint Your Peach is not responsible for delays caused by postal or courier services. If a parcel is lost in transit, Paint Your Peach will assist where possible with enquiries, however final outcomes depend on the courier/provider.
10. Address Accuracy
It is the customer’s responsibility to provide the correct shipping address at checkout. Paint Your Peach is not liable for orders delivered to an incorrect address provided by the customer.
11. Safety Disclaimer
Paint Your Peach kits may include acrylic paint and other art materials. Customers are responsible for safe use and handling of all products.
Paint Your Peach is not liable for injury, allergic reactions, damage, accidental ingestion, or misuse of materials. Adult supervision is recommended where children are present.
12. Copyright & Use
All Paint Your Peach designs and artwork remain the intellectual property of Paint Your Peach. Kits are for personal use only and may not be copied, reproduced, resold, or used commercially without written permission.
